Terms of Service

These terms govern your use of fobtap, operated by Alexey Krasnoperov, Zeppelinstr. 73, 81669 Munich, Germany (see the Impressum). By creating an account or claiming a fob you agree to them. If you do not agree, do not use the service.

1. The service

fobtap hosts public profile pages reachable by tapping an NFC key fob, scanning a QR code or opening a profile URL. Organizations can issue branded fobs to their members. The service is currently free of charge and offered as a pilot: we may change, add or remove features at any time. If we discontinue the service entirely, we will give at least 30 days' notice by email so you can save your content.

2. Eligibility and account

• You must be at least 16 years old to create an account.
• You sign in with your Google account; keep it secure. Anything done from your account is yours.
• One handle per person. Handles are first-come, first-served; we may reclaim handles that impersonate people or organizations, or that are offensive.

3. Your content

• Everything on your profile (name, headline, bio, photo, links) is published publicly and can be saved by anyone as a contact card. You decide what goes there.
• You must hold the rights to what you publish, and it must not be unlawful, deceptive, infringing, harassing or otherwise harmful. We may remove such content and suspend or delete accounts that publish it. Where reasonable we tell you first.
• You grant us the non-exclusive right to host, display and technically process your content for the purpose of running the service, for as long as it is on your profile. You keep all other rights.

4. Fobs

• A fob is a physical tag that points to a profile URL. Claiming a fob binds it to your account; the fob itself stays your property (or the issuing organization's, where they say so).
• Organization-issued fobs show the organization's branding and links alongside your profile. The organization controls that branding; you control your profile. Organization admins can see your handle, email and fob tap counts, and can release your fob (see the Privacy Policy).
• Fobs are consumer electronics of simple kind. We cannot promise that every phone reads every tag in every situation, or that a tag survives rough handling.

5. Organizations

If you administer an organization on fobtap, you are responsible for how you use members' data shown to you and for having the right to register email addresses for pre-assigned fobs. You may only use that data to run the organization's fob program.

6. Availability

We aim to keep the service available but do not guarantee uninterrupted operation. As a free pilot it can be paused for maintenance, migration or when we run out of capacity.

7. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under mandatory statutory provisions such as product liability law. For simple negligence we are liable only for breach of an essential contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible at all and on which you may regularly rely), and then only for the foreseeable damage typical of this kind of contract. Beyond that, liability is excluded. Because the service is free, we are additionally not liable for defects unless we fraudulently concealed them (§ 524 BGB applies accordingly).

8. Termination

• You can delete your account at any time from the dashboard; your profile and fobs are released immediately and your data is deleted as described in the Privacy Policy.
• We may terminate an account with 14 days' notice, or immediately for a serious breach of these terms.

9. Changes to these terms

We may update these terms when the service or the law changes. We announce material changes on this page and on the dashboard at least 14 days before they take effect; if you keep using the service after that date, the new terms apply. If you do not agree, you can delete your account.

10. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer living in another EU country, you also keep the protection of the mandatory provisions of your home country's law. We do not take part in dispute resolution before a consumer arbitration board.
